Majority of parking fine appeals won by consumers

The vast majority of consumers end up winning parking fine appeals, according to a recent report. The report indicates that a massive 94% of consumers win parking fine appeals, and this happens when they go through a public appeal against parking tickets. In six months just over 9500 Westminster issued fines were taken to an adjudicator, and over 8900, or 94%, were lost at appeal.

However, officials that campaign on behalf of those that are issued with these fines say that sometimes the appeals are turned down without a fair hearing in the hope that the consumer will just pay up.

One official said: ‘The statistics demonstrate councils’ intent to maintain duress on motorists for the longest possible period. It shows councils are abusing the system, especially when they don’t even defend the tickets at appeal. It sends out a message to the public: should those tickets have been issued at all? This is a wholly unacceptable attempt to maximise income.’

However, an official from the council said that officials often do not receive the full details relating to a complaint. He said: ‘When new evidence becomes apparent, the council often decides not to contest. If the evidence had been fully presented earlier the case might not have gone to appeal. We urge motorists to appeal if they feel they have a case.’

Another official said that the number of uncontested appeals was falling, stating: ‘We have introduced common sense parking measures. In six months, this has resulted in nearly 40% fewer tickets being issued to resident permit holders.’
